Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Packwares website and application (the "Service") operated by Packwares ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

Packwares provides a cloud-based ERP solution designed for corrugated box manufacturers. The Service includes order management, inventory control, production planning, cost estimation, and related tools.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

• You must be at least 18 years old to use this Service
• You are responsible for maintaining the confidentiality of your account
• You agree to notify us immediately of any unauthorized use of your account
• You may not use another user's account without permission

4. Subscription and Payments

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis.

At the end of each Billing Cycle, your subscription will automatically renew under the same conditions unless you cancel it or Packwares cancels it. You may cancel your subscription renewal through your online account management page.

5. Free Trial

Packwares may offer a free trial to new users. At the end of the free trial period, your subscription will begin, and you will be charged the applicable subscription fees unless you cancel before the trial ends.

6. Acceptable Use

You agree not to use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To interfere with or circumvent the security features of the Service

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Packwares. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.

8. User Content

You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, and distribute such content solely for the purpose of providing the Service.

9. Data Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

11. Limitation of Liability

In no event shall Packwares, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

12. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
